After almost three years of investigations, the Public Ministry this week denounced people involved in Operation Pandora's Box, which uncovered accusations of a corruption scheme in the administration of José Roberto Arruda in the government of the Federal District. The scandal became known as the DEM monthly allowance. The information was confirmed, this Friday (/), by the Attorney General of the Republic, Roberto Gurgel.
In this way, the continuity of the investigation, within the scope of the SBDC, of complaints not corroborated by overwhelming evidence of cartel practice will not prove to be effective, making the archiving of representations a measure not only of rigor, but of a fundamental saving of public resources and, consequently, , greater efficiency of the SBDC bodies to carry out the functions assigned to them by law.
It should be noted that the understanding enshrined in Administrative Process /-, mentioned above, served as a paradigm for the judgment of several other processes, such as the Preliminary Inquiry /-, which found alleged cartel practice by the gas stations fuel retailers in the municipalities of Macapá and Santana (AP). Also mentioned is Preliminary Inquiry no. /-, established based on a representation forwarded BTC Number Data by Procon/AL, following a complaint made on the “Linha Direta” program on Rádio Gazeta de Alagoas about the possible formation of a cartel by fuel dealers in the capital of Alagoas. Finally, it is worth mentioning the Preliminary Inquiry /-, promoted, on behalf of the Public Ministry/MG, to investigate the alleged cartel practice by gas stations in the municipality of Divinópolis/MG.
Finally, it must be recognized that some regulatory standards, which deal with vertical relationships between fuel distributors and resellers, need to be evaluated through an interaction between the antitrust authority and the regulatory authority (aiming at complementary action), so as to to eliminate any regulatory gap that encourages the formation of a cartel in the market in question.
According to the prosecutor, the investigations proved that companies benefiting from contracts without bidding with the government of the Federal District paid bribes to politicians allied with the government. Those involved were charged with crimes of active (businessmen) and passive (politicians) corruption and money laundering.
Gurgel reported that the leader of the scheme was Arruda himself and that Durval Barbosa was confirmed as one of the scheme's operators. The complaint also involves district deputies and businesspeople. Although he did not disclose how much money was embezzled, the prosecutor confirmed that the scheme began shortly before the elections.
The former governor of the Federal District Joaquim Roriz, who at the time was a senator, was cited, but was not denounced because his advanced age would prevent punishment. With information from Agência Brasil.
